Binding Individual Arbitration

In such instances, we are committed to working with you to find a reasonable resolution that satisfies both parties. To achieve this, we need to be informed and understand your issue fully. Therefore, if you have any problems or disputes with Foresea or our affiliates, you agree to first provide us with the opportunity to resolve them.

You agree to engage in good-faith negotiations for at least 60 days after notifying us of the dispute. If Foresea or our affiliate fails to resolve the dispute within this timeframe, you, Foresea, or the affiliate involved in the dispute may pursue arbitration as outlined in this Section.

You acknowledge that arbitration is the sole and exclusive forum and remedy for any disputes or claims that cannot be resolved informally and relate to or arise out of the website or these Terms of Use. However, this provision does not apply if you have infringed upon or violated our or any third party's intellectual property rights, in which case legal action may be sought. We recognize that these Terms of Use impact interstate commerce, and therefore, the Federal Arbitration Act and federal arbitration law govern arbitrations under this Agreement.

Exclusions from Arbitration: Both you, us, and our affiliates agree that any claim filed by you, us, or our affiliate in small claims court is not subject to the arbitration terms outlined in this section.

Right to Opt Out of Binding Arbitration and Class Action Waiver within 30 Days: If you do not wish to be bound by the binding arbitration and class action waiver stated in this section, you must notify us in writing within 30 days of accepting this agreement. Your written notification must be sent to info@foresea.co.uk and must include: (1) your name, (2) your address, (3) your account number, if applicable, and (4) a clear statement indicating your desire not to resolve disputes with us or our affiliates through arbitration.

Jury Waiver: We both agree that, whether any claim is in arbitration or court, we waive any right to a jury trial involving any claims or disputes between us.

Class Action Waiver: Any dispute resolution proceedings, whether in arbitration or court, will be conducted only on an individual basis and not in a class or representative action or as a named or unnamed member in a class, consolidated, representative, or private attorney general legal action, unless both you and the entity with which you have a dispute specifically agree to do so in writing following initiation of the arbitration.

Time Limitation on Claims: You agree that regardless of any statute or law to the contrary, any claim or cause of action that you may have arising out of or related to the use of this website or these Terms of Use must be filed by you within one year after such claim or cause of action accrued or be permanently barred.
